Washington Inheritance Law: What Tacoma Residents Should Know

Washington is one of nine community property states, and that status directly affects how a spouse’s estate is divided when there’s no will. When someone dies without a will, the state’s intestate succession law under RCW 11.04.015 determines who inherits and in what order. These default rules don’t protect unmarried partners or stepchildren unless they’re named in a will or beneficiary designation.

Washington doesn’t levy a state inheritance tax, but it does impose a state estate tax. Under the law as amended effective July 1, 2026, the exemption is $3,000,000, with a top rate of 20%. Verify current figures with the Washington Department of Revenue before making planning decisions based on these thresholds.

Not every asset goes through probate. Non-probate assets such as jointly owned property with right of survivorship, payable-on-death accounts, life insurance with a named living beneficiary, and assets held in a living trust pass directly to beneficiaries outside of court proceedings. For estates with $100,000 or less in probate assets, Washington’s small estate affidavit process under RCW 11.62 may allow distribution without a formal court proceeding, available at least 40 days after the date of death. Pierce County residents file probate proceedings in Pierce County Superior Court.
